Terms and Conditions

Sunny Side Sailing provides training, charters, and other services under the following Terms and Conditions. By booking with Sunny Side Sailing, the Client agrees to abide by these terms.

1.    Sunny Side Sailing – Definitions. The “Company” refers to Sunny Side Sailing. The “Client” refers to the individual or organisation booking services with the Company. The “Charterer” refers to the person named on the booking form who hires the Vessel. The “Vessel” refers to the yacht or boat provided by the Company for the agreed service. The “Skipper” refers to the individual responsible for the operation and navigation of the Vessel. “Bareboat Charter” is where the Client operates the Vessel without a Skipper provided by the Company. “Skippered Charter” refers to a service where the Company provides a Skipper to operate the Vessel. “Skippered Instruction” refers to a service where the Skipper provides training and instruction to the Client.

 

2.    Acceptance of Terms. By providing customer details and making a booking, the client confirms that they have read, understood, and agree to the Terms and Conditions as published on the Sunny Side Sailing website. These Terms and Conditions form the basis of the client’s agreement with us and apply to all bookings made through our platform.

 

3.    Booking and Payment. A non-refundable deposit of 25% of the total booking fee is required to secure a booking for training services or courses. For charters, a deposit of £2,500 is required. The balance of the payment is due 28 days prior to the start date. For bookings made within 28 days of the start date, full payment is required at the time of booking. Payment can be made via bank transfer, credit card, or any other method specified by the Company. .

 

4.    Booking Confirmation. All bookings made through our platform are considered provisional until we have reviewed the client’s request and confirmed the booking via email. No booking is deemed confirmed or binding until a formal confirmation email is sent from Sunny Side Sailing to the client. If we are unable to confirm a client’s booking, any payment made will be refunded in full. Sunny Side Sailing reserves the right to decline any booking request at its discretion.

 

5.    Security Deposits for Charters. A £2,500 refundable security deposit is required for both Skippered and Bareboat Charters. This deposit covers damage to the Vessel or its equipment, loss of equipment or accessories, and failure to return the Vessel in the agreed condition, including late return or insufficient fuel. The deposit must be paid in full no later than 7 days before the charter start date. If payment is not received, the booking may be cancelled, and the deposit forfeited. The security deposit will be refunded in full within 7 days of the Vessel’s return, provided no deductions are necessary. Deductions from the deposit may occur for repairs or replacement costs for damage or loss, cleaning fees if the Vessel is returned in an unreasonably dirty state, and late return fees (£100 per hour, up to the full daily rate). In the event of major damage exceeding the deposit amount, the Charterer will be liable for the excess costs not covered by the Vessel’s insurance policy.

 

6.    Cancellation by the Client. All cancellations must be submitted in writing to the Company. For training services or courses, if cancellation occurs more than 28 days before the start date, only the deposit will be forfeited. If cancellation occurs within 28 days of the start date, the full booking fee is forfeited. For charters, if cancellation occurs more than 28 days before the charter start date, the deposit of £2,500 is forfeited. If cancellation occurs within 28 days of the charter start date, 100% of the total charter fee will be forfeited.

 

7.    Cancellation by the Company. The Company reserves the right to cancel or modify services due to unforeseen circumstances, including but not limited to adverse weather, safety concerns, or if the Vessel becomes unseaworthy for any reason whatsoever. In the event of cancellation by the Company, the Client will be offered an alternative date, a replacement Vessel of similar size and specification, or a full refund of the booking fee or deposit. The Company shall not be liable for additional costs incurred by the Client, such as travel or accommodation expenses.

 

8.    Use of the Vessel. The Vessel must be used responsibly and in accordance with all local maritime laws and regulations. The Vessel must not be sailed or used beyond the coded constraints of the Vessel. The Client or Charterer agrees not to carry more passengers than specified in the Vessel’s capacity or engage in illegal activities or activities that endanger the Vessel, its crew, or others. The Vessel may only be used for activities within the scope of the Client’s documented skills or qualifications. Smoking and the use of recreational drugs are strictly prohibited onboard.

 

9.    Insurance and Liability for Clients. The Client is advised to arrange personal travel insurance that includes cancellation coverage, personal liability, and accident cover for sailing activities. Sunny Side Sailing will not be liable for any injury, loss, or damage to personal belongings unless caused by negligence on the part of the Company or its staff. In the case of Bareboat Charter, the Charterer assumes full liability for the Vessel and any damage caused through misuse or negligence during the charter period.

 

10.    Force Majeure. Sunny Side Sailing shall not be held liable for delays, interruptions, or cancellations caused by force majeure events, including but not limited to war, acts of terrorism, natural disasters, pandemics, or government restrictions. In such cases, the Company will make every effort to reschedule or provide alternative arrangements, but refunds may be limited based on costs incurred by the Company.

 

11.    Health and Safety. It is the Client’s / Charterer’s responsibility to ensure they (and for charterers, their crew) are medically fit to participate in the booked activities. The Company must be informed of any medical conditions, allergies, or disabilities at the time of booking and during the introductory safety brief. Clients must wear appropriate safety equipment, including life jackets, as directed by the Skipper or instructor. Failure to comply may result in exclusion from activities without refund.

 

12.    Medical Conditions, Allergies, and Disabilities. We are committed to making reasonable adjustments to accommodate medical conditions, allergies, and disabilities to ensure your safety and comfort. However, we reserve the right to assess each case individually and may be unable to confirm a booking if the required adjustments are beyond what we can reasonably manage within the scope of our operations. If you have specific needs, please contact us prior to booking to discuss how we can best support you.

 

13.    Complaints and Dispute Resolution. Any complaints regarding the service provided must be raised immediately with the Skipper or a Company representative during the charter or course. If a satisfactory resolution cannot be reached, a formal written complaint must be submitted to Sunny Side Sailing within 14 days of the service’s conclusion. Disputes that cannot be resolved amicably will be referred to an independent mediator, with both parties agreeing to share mediation costs equally.

 

14.    Photography and Media Consent. By participating in courses or charters, the Client consents to Sunny Side Sailing using photographs or videos taken during activities for marketing and promotional purposes. Clients who do not wish to be photographed must inform the Company in writing before the start of their course or charter.

 

15.    Environmental Responsibility. Sunny Side Sailing is committed to minimising its environmental impact. Clients are expected to adhere to sustainable practices, including proper disposal of waste, recycling onboard, and avoiding damage to marine ecosystems. Pump-out facilities should be used in marinas where available, and anchoring in sensitive areas should be avoided unless buoys are provided.
